U.S. Immigration Non-immigrant Visas

B-1 Visa A B-1 visa is typically used for visitors. Visitors are not authorized to work in the U.S. and are required to maintain a foreign residence abroad to which they intend to return after their visit in the U.S.

B-2 Visa A B-2 visa is used to allow individuals to come to the U.S. for a short period of time for activities including pleasure, tourism, social or service activities, or for medical treatment.

E-1 Visa The E-1 is used for a treaty trader and allows a person to come to the U.S. for the purpose of carrying out substantial international trade.

E-2 Visa – The E-2 visa is used for a treaty investor and allows a person to come to the U.S. for the purpose of furthering substantial investments in the U.S.

F-1 Visa The F-1 visa allows individuals to come to the U.S. in order to carry on a course of study with an accredited academic program as a full time student.

H-1B Visa The H-1B visa classification allows a person to come to the U.S. to work in a specialty occupation. There is an annual cap of 65,000 for the H-1B regular cap visa currently. For those who are in a specialty occupation as a Masters graduate, there is also a separate cap for the H-1B visa that they may qualify for.

H-3 Visa – The H-3 visa allows individuals to come to the U.S. in order to obtain training to pursue a career outside of the United States.

J-1 Visa The J-1 visa allows individuals participating in a recognized international exchange program to come to the U.S. for studies or for work and includes those working for an Au Pair program. The purpose of this visa is to promote both cultural and educational exchange between the U.S. and other countries. Some J-1 visa holders are subject to a 2-year foreign home residency requirement following their visit to the U.S.

K-1 Visa The K-1 visa is known as the “fiance” visa and allows an individual who is engaged to a U.S. citizen to come to the U.S. and wed.

K-3 Visa – The K-3 visa is used for those who are already married to a U.S. citizen and who wish to enter the U.S. to be with their spouse and complete the permanent residence (green card application) process.

L-1 Visa – The L-1 visa applies to intracompany transferees who have been employed outside of the U.S. for at least one year in a managerial or executive/similar type position within the three preceding years of the L-1 visa application.

O-1 Visa The O-1 visa applies to individuals who have an extraordinary ability in science, business, arts, education, or athletics. This visa is also typically used by entertainers in the television or motion picture industries.

TN-1 Visa – This visa applies to individuals from Canada who wish to come to the U.S. to engage in business activities at a professional level.

TN-2 Visa Like its counterpart above, the TN-2 visa applies to individuals from Mexico who intend to work in the U.S. in positions qualified as professional positions by NAFTA.
